A rental agreement in Hyderabad is the written contract between the owner (landlord) and the tenant. It records the flat, the monthly rent, the security deposit, the 11-month term, lock-in, notice, pets, and what happens if the tenancy is renewed. Without it, both sides rely on WhatsApp messages that a court may or may not treat as proof.

What is a rental agreement?

A rental agreement (also called a leave and licence / residential tenancy agreement in everyday speech) is a contract. The owner lets a specific premises to the tenant for a stated term, at a stated rent, with a refundable deposit and rules on use.

In Hyderabad it should name:

  • Full names, parentage if used, phones, emails, and permanent addresses of Owner and Tenant
  • The premises: house/flat number, locality, Hyderabad, PIN, BHK, furnishing, type (apartment, independent house, villa, studio)
  • Monthly rent, due date, and whether society maintenance is extra
  • Security deposit and how it will be refunded
  • Start date and end date (for HousingPal, end date is 11 months minus one day)
  • Lock-in, notice, occupants, pets
  • Rent increment on renewal
  • Any extra covenants both sides actually agreed (parking, visitor rules, early-exit money, inventory)

If it is not in the document, do not assume a court will imply it.

Why Hyderabad uses 11-month rental agreements

Under the Registration Act, 1908, leases of immovable property from year to year, or for any term exceeding one year, or reserving a yearly rent are generally compulsorily registrable. An 11-month term is the market’s way of keeping the arrangement under twelve months, so parties typically do not register the instrument as a 12-month lease.

Important caveats:

  • Stamp paper and notarisation are not the same as registration.
  • An unregistered 11-month agreement is still widely used; it is not a guarantee of every remedy a registered lease might give.
  • HousingPal does not opine on stamp-duty quantum for your particular rent. We arrange printing on stamp paper as fulfilment.

If you need a 12-month registered lease, use an advocate and the Sub-Registrar. That path is not on HousingPal yet.

Stamp paper, notary, and courier — what HousingPal actually does

After you pay:

  1. You receive a link to review the full draft (parties, recitals, numbered clauses, signatures, witnesses, notary block).
  2. You confirm it, or request edits / change names, rent, increment, extra terms.
  3. Only after confirmation do we print on stamp paper, notarise, and courier one hard copy (or two if you paid for the extra copy) to a Hyderabad 500xxx address.

Rent increment (the clause owners forget)

In Hyderabad, rent is almost always fixed for the 11-month term. Increases happen if the tenancy continues after expiry, typically 5–10%, unless you write something else.

HousingPal’s default is 10% on renewal. Example: rent ₹30,000 → renewal rent ₹33,000, unless you set 0% or another figure (0–50%) on the form.

Put the percentage in the agreement before anybody moves in. A WhatsApp “we will see next year” is how disputes start.

How to get a rental agreement in Hyderabad (step by step)

  • Signed rental agreement (hard copy)
  • ID copies (Aadhaar / PAN as you both agree)
  • Inventory / photos of fixtures on handover
  • Receipts for deposit and token advance
  • Society rules / parking allocation if any

11-month vs 12-month vs “leave and licence”

People mix these phrases:

  • 11-month residential agreement — Hyderabad default; HousingPal’s product; typically not registered as a 12-month lease.
  • 12-month (or longer) lease — generally registrable; not offered on HousingPal yet.
  • Leave and licence — a label used in some states; in Hyderabad speech, people still say “rental agreement.” The HousingPal heading is Residential Rental Agreement.

Do I need to register an 11-month rental agreement in Hyderabad?

Who should pay for the rental agreement — owner or tenant?

Either. The form asks who is paying. The tenancy itself is between Owner and Tenant regardless of who paid HousingPal.

Is a notarised agreement the same as a registered lease?

No. Notary attestation is not Sub-Registrar registration.

Can I edit the draft after paying?

Yes, while the order is awaiting confirmation. You can change names, rent, increment, extra terms, then confirm. Extra copy and amount cannot be changed after payment.

What if I need extra clauses (parking, inventory, early exit)?
